Accepting these Terms
These Terms of Use (the Terms) are a binding
agreement between you and Dear Jane (Dear Jane,
we, us or
our). They govern your access to and use of
dearjane.me, the Dear Jane mobile
experience, every page rendered under dearjane.me, and
every API, plugin or related service we offer (together, the
Service).
You accept these Terms when you do any of the following: (a) tick the consent checkbox during sign-in or sign-up, (b) create an account, (c) log into an existing account after the effective date above, or (d) continue to use any part of the Service. If you do not agree to any part of the Terms, you must stop using the Service and close any account you may have.
These Terms incorporate by reference our Privacy Policy, our Community Guidelines (when published), and any additional rules we may post inside the Service for specific features (for example, payment terms shown on the checkout screen). If there is a conflict between these Terms and a feature-specific rule, the feature-specific rule controls for that feature only.
Definitions
- Account
- The unique credentials and profile that allow you to access the Service.
- Content
- All material you submit to the Service, including text, photos, videos, voice notes, profile fields, messages and metadata.
- Member
- Any person who has registered for the Service.
- Membership
- A paid subscription tier — for example, "Plus" or "Elite" — which unlocks additional features for a billed period.
- Match
- Two Members who have mutually expressed interest through the Service's like, save or message actions.
- Sophie
- An automated agent operated by Dear Jane that may send opening messages, suggest text or surface profile activity. Where Sophie or any other automated account interacts with you, the Service will disclose that interaction as automated.
- Private Gallery
- A separate photo album you may make available to a subset of Members under the visibility rules you set.
- Trip / Travel
- A declared travel intention you publish through the Service to be discovered by Members in or willing to travel to the same city.
- Processor
- A third party we engage to process information on our behalf (for example, Stripe for payments).
- Force Majeure Event
- Any event beyond our reasonable control — including war, civil unrest, government action, pandemic, fire, flood, earthquake, power outage, telecommunications failure, cyber-attack, or refusal of a Processor to continue providing service.
About Dear Jane
Dear Jane is an online platform that lets adults discover one another, exchange messages and media, set out travel intentions, and decide for themselves whether and how to meet in person. The Service provides tools, ranking signals and infrastructure — every interaction and decision is between Members, not us.
Dear Jane is not an escort agency, introduction bureau, matchmaking service, financial product, escrow agent, relationship-counselling provider, sponsorship marketplace, or recruitment service. We make no promise that any Member will be a good match for you, will respond to your messages, will turn up to a meeting, will behave as their profile suggests, or has any particular financial means.
Some features are free, some require a Membership, and some individual interactions inside chat (for example, sending a photo from your Private Gallery) may be gated separately. The functional difference between tiers is shown on the plan picker. We may add, remove, rename, gate or change the price of any feature at any time.
Eligibility
To create an account or use the Service, you must:
- be at least 18 years old, and the age of majority in your country or state of residence;
- be legally able to enter into a binding contract under the law of that jurisdiction;
- not be on any sex-offender registry in any jurisdiction;
- not be the subject of any court order, restraining order or other restriction that limits your ability to use an online dating service or contact other people through one;
- not be located in, ordinarily resident in, or a national of any country or territory subject to comprehensive sanctions by the United Nations, the European Union, the United States, the United Kingdom or the Republic of Cyprus;
- not have been previously removed from the Service by Dear Jane (unless we have explicitly invited you back in writing);
- not be using the Service on behalf of a business unless that business is a paid commercial partner with an explicit written agreement with us.
You agree to provide truthful information about your age, identity and location and to update it if it changes. We may verify any of the above at any time — including by asking for a government-issued ID, a video selfie, or other proof — and may suspend or terminate your account if we cannot reasonably confirm eligibility.
Your account & security
How accounts are created
Dear Jane accounts are created and authenticated through our identity provider (currently Auth0). You may sign in with a supported social provider or with a username and password. Either way, the account that results is yours alone.
One account per person
Each natural person may hold a single active account at a time. We prohibit, and reserve the right to immediately remove, all of the following: maintaining multiple accounts, sharing an account with another person, transferring or selling an account, registering on behalf of someone else, and operating automated, simulated or "bot" accounts other than the official Sophie agent operated by us.
Keeping your account secure
You are responsible for keeping your sign-in credentials confidential and for every action that takes place through your account, whether taken by you or by anyone who obtained access to it. Notify us immediately at security@dearjane.me if you suspect any unauthorised use.
Accuracy & updates
You must keep your profile information current, complete and non-misleading. We may remove or hide a profile we reasonably believe is inaccurate, misleading, deceptive or impersonates another person.
Identity & selfie verification
To keep the community real, every new Member completes a one-time selfie / liveness check before getting full access. The check runs entirely on your device: your browser asks for camera permission, captures frames into a hidden HTML canvas, runs a face- and-motion detector against them locally, and posts only a single boolean ("verified: yes") to our server when the check passes. The frames are never transmitted, never stored, never written to backups and never used to train any model.
We may, at any time, ask you to re-verify, complete an additional identity check (for example, a government ID with a matching live selfie), or stop using the Service if we cannot reasonably confirm that you are who you say you are. Refusal to comply, or repeated failure to pass identity checks, is grounds for suspension or termination.
Verification of any kind does not mean we have run a background, criminal or financial check on the Member, that we endorse them, or that we vouch for their safety as a partner. See Section 14.
Your content & licence
Your Content means everything you upload, type, send or otherwise submit through the Service: photos and videos, voice notes, profile fields, free-text answers, personality- quiz responses, messages, attachments, travel destinations, and any metadata associated with the foregoing.
You keep ownership
You own Your Content. Submitting it to Dear Jane does not transfer that ownership.
What you grant us
You grant Dear Jane a worldwide, non-exclusive, royalty-free, fully paid-up, sub-licensable and transferable licence to host, store, cache, copy, transmit, display, perform, reformat, translate, technically modify (for example, to resize an image or transcode a video), excerpt and otherwise use Your Content for the limited purposes of (a) operating, securing and improving the Service, (b) showing it to the Members you have decided to share it with, (c) moderating it for compliance with these Terms, and (d) creating non-identifying aggregate analytics. This licence lasts only for as long as we need it to do these things — and ends when you delete the underlying content or close your account, except where (i) we are required by law to retain a copy, (ii) a copy has been shared with another Member in chat and is part of their inbox, or (iii) a copy remains in encrypted backups during the rolling backup retention window.
What you confirm
When you submit Your Content you confirm that:
- you either own it, or have the necessary rights and permissions to upload it and to grant the licence above;
- photos and videos depict you (or, in shared shots, depict other adults who have consented to the upload);
- it does not violate any law, court order, contract or anyone else's rights — including rights of privacy, publicity, copyright, trademark, trade-secret and moral rights.
Feedback
If you send us suggestions, improvements, bug reports or ideas about the Service, you grant us a perpetual, irrevocable, royalty-free right to use them without obligation to you. We will of course never attribute your feedback publicly without your consent.
Photo rules
Photos visible on a public profile must:
- actually depict you, taken within the last two years;
- show your face clearly in at least one image;
- not be photoshopped, AI-generated, deep-faked or substantively re-touched in a way that misrepresents how you actually look today;
- not contain nudity, exposed genitalia, sexual acts, sexual paraphernalia or content typically classified as pornography;
- not contain other people whose face is identifiable, unless they have consented to appear on a public dating profile;
- not include children, even your own, in the cover or thumbnail position;
- not contain personal contact information (phone, email, social handles, addresses);
- not be a meme, a stock photo, an animal, a vehicle, a logo, a piece of art, or a screenshot of another social media profile;
- not infringe any third-party intellectual-property right.
We use both automated systems and human reviewers to enforce these rules. Photos that fail will be hidden until corrected, and repeated violations may result in account suspension under Section 24.
Private galleries
You may upload additional photos to a Private Gallery and use the visibility controls on your profile to decide who sees them: "Matches only", "After first message", a specific Member you have unlocked it for, or "Nobody" (default).
Private Gallery content still must comply with the law and with the non-illegal portions of Section 8: no minors, no third parties without consent, no non-consensual imagery, no content depicting illegal activity. Nudity that is otherwise lawful and depicts the consenting adult Member is permitted in Private Galleries, where local law allows it.
Granting someone access to your Private Gallery does not authorise them to download, copy, redistribute, screenshot, post or otherwise re-publish its contents. Doing so is a breach of these Terms and may be a criminal offence in your jurisdiction — including "intimate-image abuse" laws in the UK, EU member states, Switzerland, the United States and Australia.
Acceptable use
The Service exists for honest, voluntary connection between adults. Treat other Members the way you would expect to be treated in a real-world social setting: with courtesy, candour and respect for "no".
This section sets the spirit; the next one (Prohibited Conduct) spells out specific behaviours that will get you removed. The list is not exhaustive. We may act on conduct that is clearly contrary to the spirit of these Terms even if it isn't named below.
Prohibited conduct
You agree not to do, or to attempt to do, any of the following:
Towards other Members
- Harass, intimidate, abuse, stalk, threaten, blackmail or doxx another Member;
- Send sexually explicit, unsolicited or threatening messages or media;
- Send unsolicited commercial messages, recruitment pitches, MLM invitations, crypto/investment promotions, spam or chain letters;
- Solicit, request or accept money, gifts, banking details, gift cards, cryptocurrency, sexual services, escorting, or any form of compensation in exchange for time, attention, photos, conversation or future favours;
- Impersonate any real or fictional person — including a celebrity, a politician, another Member, or Dear Jane staff — or misrepresent your age, identity, relationship status, location, occupation or financial situation;
- Publish, post, link to or otherwise expose another Member's personal data — phone number, address, employer, social handles, family relationships — without their explicit, prior consent;
- Take, save, screenshot, download, copy, redistribute or re-publish another Member's photos or messages outside the Service, except when expressly permitted by them in writing.
Content rules
- Upload content depicting minors in any romantic, sexual, suggestive or otherwise compromising context — ever; we report to law-enforcement and to NCMEC;
- Upload non-consensual intimate imagery of any person;
- Upload terrorist content, hate speech, content advocating self-harm or suicide, content depicting cruelty to animals, or content promoting eating disorders;
- Upload counterfeit-goods imagery, IP-infringing content, or content advertising illegal goods or services;
- Upload anything you don't have the legal right to share.
Towards the Service
- Scrape, crawl, mass-download, harvest, index, or otherwise extract data from the Service except through channels we explicitly publish (we have no public API today);
- Reverse-engineer, decompile, disassemble, decrypt, or otherwise attempt to derive the source code of the Service;
- Interfere with, disrupt, overload or impair the operation of the Service or anyone else's use of it;
- Bypass, disable or interfere with security or rate-limiting features;
- Probe, scan or test the vulnerability of the Service except under a written agreement (see security@dearjane.me);
- Use the Service through a virtual private network, proxy or other tool intended to evade an active suspension or to misrepresent your location;
- Use the Service for any commercial purpose other than purchasing a Membership we offer.
Zero tolerance. Reports of harassment, scams, fake profiles, payment fraud or child-safety concerns are reviewed immediately and may result in permanent removal without prior notice. We cooperate with law-enforcement on lawful requests and, in suspected crimes against minors, proactively report to the appropriate authority.
Reports & moderation
Every profile, photo and message can be reported through the Service. Reports are reviewed by our trust-and-safety team — a mix of automated triage and human reviewers — typically within 24 hours, and faster for safety-of-life issues.
Outcomes we may apply include: hiding the reported content, suspending a profile pending investigation, terminating a profile, banning the underlying person from creating new accounts, refusing refunds for the terminated profile, and — where the law requires — preserving and disclosing relevant data to authorities.
We do not commit to act on every report, to act in the way the reporter expects, or to share the outcome of an investigation with the reporter. We do, however, commit to acting in good faith and in proportion to the conduct reported.
Meeting people in person
The decision to meet another Member is yours alone. Dear Jane does not arrange, supervise, escort, finance, or insure meetings — and cannot guarantee the identity, intentions, sobriety, safety or honesty of anyone you choose to meet.
Before meeting anyone:
- video-chat at least once;
- tell a friend or family member where you'll be, with whom, and when you'll be back;
- meet in a public, well-lit place; do not meet at your home, their home, or a hotel room as a first meeting;
- arrange your own transportation; do not get into a stranger's vehicle on a first meeting;
- keep your drink within sight; never leave it unattended;
- trust your instincts — if something feels off, leave.
These tips reduce risk; they do not eliminate it. If something happens during or after a meeting, contact local emergency services first and report the incident to us at safety@dearjane.me.
No background checks
Dear Jane does not conduct criminal background checks, sex-offender register searches, financial-history checks, employment verification, identity-document authentication beyond the selfie liveness check, or any similar vetting on Members. Self- declared information on a profile — name, age, occupation, income, marital status, intentions — is the Member's representation, not ours. Treat it accordingly.
We may, however, query public sanction lists, payment-fraud signals and our internal abuse history when a Member registers, pays, or triggers a fraud heuristic.
AI-assisted features
Parts of the Service use automated systems — including AI models — to rank profiles in your feed, suggest opening messages, draft profile copy, score trust signals, and flag suspicious content. Some of these systems are operated by us; others run on third-party AI infrastructure (currently OpenAI).
You will encounter at least one automated account on the Service: Sophie, an agent operated by Dear Jane that may send opening messages and surface platform updates. Sophie's profile is marked as an Dear Jane-operated automated account. Conversations with Sophie are not human conversations; do not share secrets, money or romantic plans with her.
Where AI generates text that you may then post (for example, an "About me" rewrite), you remain responsible for the final published version: review it, change it, and post only what you actually want to say.
AI-generated suggestions are not advice — medical, legal, financial, romantic or otherwise. They are heuristics. Use your judgement.
Travel feature
The Travel feature lets you publish a list of cities you would like to visit or be hosted in. Members in those cities — and Members searching for company in those cities — can then discover you.
Publishing a city is an expression of interest, not a commitment. It is not an invitation to be hosted financially, an agreement to be transported, a promise of intimacy, or an acceptance of a paid arrangement. Any concrete plan — flights, dates, accommodation, exchange of value — must be negotiated between the Members themselves, off-platform, with the same caution you would use for any other meeting (see Section 13). Dear Jane is not party to those negotiations and has no role in executing them.
Memberships & billing
Some Service features are available only to Members on a paid tier. Pricing, currency, billing cycle, included features and exclusions are shown on the plan picker and on the checkout confirmation screen at the moment you purchase. By completing checkout you agree to be charged in accordance with those terms.
How payments are handled
Payments are processed by Stripe Inc. ("Stripe"), a PCI-DSS certified payment processor. Dear Jane never sees, stores, processes, or transmits your full card number — Stripe does. The Stripe End User Terms apply to your payment. We receive only the metadata necessary to issue the Membership: the tier purchased, the billed amount, the billing dates, the country, and the last four digits of the card or the masked wallet identifier.
Promotional credit
We may from time to time offer promotional credit, complimentary days, or discounted introductory pricing. Promotional credit has no cash value, is non-transferable, cannot be combined with other offers unless we say so, and may be revoked if obtained through abuse or misrepresentation. Promotional pricing reverts to standard pricing at the end of the promotional period.
Auto-renewal & cancellation
Recurring Memberships renew automatically at the end of each billing period for the same billed term and at the then-current price for that tier, until cancelled by you.
How to cancel
You may cancel at any time from Settings → Membership → Cancel inside the Service, or by writing to support@dearjane.me with the email address on file. Cancellation takes effect at the end of the current paid period; you keep all paid features until then.
Price changes
We may change prices for new Memberships at any time. For active recurring Memberships, the existing price stays in place until the end of the current prepaid term. Any change for the next renewal will be communicated by email to the address on file at least 30 days before it takes effect, and the renewal notice will give you the option to cancel before the new price applies.
Refunds & right of withdrawal
Unless required by mandatory consumer-protection law in your country of residence, fees you have paid are non-refundable once the corresponding billing period has begun. Specifically, we do not refund:
- partial months or partial quarters;
- unused premium features;
- days during which the Service was available but you didn't use it;
- periods following a termination triggered by your breach of these Terms;
- amounts deducted as taxes or third-party fees that we have already remitted.
EU 14-day withdrawal
If you live in the European Economic Area, the United Kingdom, or Switzerland, the EU Consumer Rights Directive gives you the right to withdraw from a Membership within 14 days of purchase. We ship the Service to you as a "digital content" product that you can begin using immediately. By starting to use paid features during the 14-day window, you expressly consent to begin performance of the contract during the withdrawal window and acknowledge that you lose the right to withdraw to the extent the service has been performed. To exercise the right within 14 days before using paid features, email support@dearjane.me with "Withdrawal — 14 days" in the subject line.
Other refund cases
We will issue a refund where (a) we are required to by mandatory consumer law in your jurisdiction, (b) we have made a duplicate charge or a clear billing error, or (c) the Service was unavailable for an extended period due to our fault and we choose, in our discretion, to issue credit. Refund requests outside these cases are evaluated on a goodwill basis and may be declined.
App-store billing
If at any point you purchase a Membership through the Apple App Store or Google Play Store, the billing relationship for that transaction is between you and the relevant store, not us. The store's terms, refund rules and cancellation procedures apply for that purchase and override the corresponding sections above to the extent of any conflict. Dear Jane cannot issue refunds for store- billed transactions; you must use the store's own refund flow (reportaproblem.apple.com for Apple, play.google.com for Google).
Third-party services
The Service relies on third-party providers, currently including:
- Auth0 (Okta, Inc.)
- Identity, login session, multi-factor authentication.
- Stripe, Inc.
- Card processing, fraud screening, subscription billing.
- Amazon Web Services, Inc.
- Cloud hosting, storage and CDN delivery.
- OpenAI L.L.C.
- Large-language-model inference for AI-assisted features.
- IP-geolocation provider
- Converting IPs into city-level locations for "near me" search.
Each third party operates under its own terms and privacy policy, listed in our Privacy Policy. We are not responsible for the acts or omissions of these third parties, nor for any service interruption caused by them, except to the extent required by mandatory law.
Our intellectual property
The Dear Jane name, logo, brand assets, source code, design system, algorithms, ranking signals, Sophie agent persona, and the look and feel of the Service are owned by Dear Jane or our licensors and are protected by trademark, copyright, trade-secret and other intellectual-property law.
We grant you a personal, non-exclusive, non-transferable, revocable and limited licence to use the Service in accordance with these Terms — and no other right. You may not copy, modify, distribute, sell, lease, frame, mirror, white-label, or create derivative works from any part of the Service without our prior written consent.
Copyright takedown (DMCA)
We respect intellectual-property rights and respond to clear notices of alleged copyright infringement that comply with section 512(c) of the U.S. Digital Millennium Copyright Act ("DMCA") and equivalent laws in other jurisdictions.
To submit a notice, send the following information to our designated agent:
- a physical or electronic signature of the rights-holder or an authorised representative;
- identification of the copyrighted work claimed to have been infringed;
- identification of the allegedly infringing material on the Service and information sufficient to locate it (e.g., the profile URL);
- your name, postal address, telephone number and email;
- a statement that you have a good-faith belief that the use is not authorised by the rights-holder, its agent or the law;
- a statement, under penalty of perjury, that the information in your notice is accurate and that you are the rights-holder or authorised to act on the rights-holder's behalf.
Send DMCA notices to dmca@dearjane.me. We may forward the notice (including your contact information) to the uploader, who may file a counter-notice. Frivolous or fraudulent notices may expose the sender to liability.
Repeat-infringer accounts are terminated.
Suspension & termination
By you
You may close your account at any time from Settings → Account → Delete account. Closure deletes your public profile, your media, your messages from your inbox and your match history. Some data may persist briefly in encrypted backups — see our Privacy Policy for the precise retention windows.
By us
We may suspend or terminate your access to the Service, in whole or in part, with or without notice, if we reasonably believe that you:
- have breached these Terms or any rule incorporated by reference;
- have caused harm or risk to another Member, to us, or to our infrastructure;
- have submitted fraudulent payment information or charged back a legitimate purchase;
- have impersonated another person or operated an inauthentic profile;
- are ineligible to use the Service under Section 4;
- are using the Service in a way that we are legally required to stop.
Effect of termination
On termination, your right to use the Service ends immediately. Sections that by their nature should survive termination (Definitions, Your Content licence to the extent already granted, Disclaimers, Limitation of Liability, Indemnification, Dispute Resolution, Governing Law, and Miscellaneous) survive.
Termination by us does not entitle you to a refund of any paid fees, except where required by applicable consumer law or where we elect, in our discretion, to issue a goodwill credit.
Disclaimers
The Service is provided "as is" and "as available", without warranty of any kind, express or implied, to the maximum extent permitted by law. Without limiting that, we specifically disclaim:
- the implied warranties of merchantability, fitness for a particular purpose, accuracy, system integration, quiet enjoyment and non-infringement;
- any warranty that the Service will be uninterrupted, secure against attack, or error-free;
- any warranty about the conduct, character, intentions, identity, age, marital status, financial means, sobriety, or background of any Member;
- any warranty that any specific match, message, meeting or relationship will result from your use of the Service;
- any warranty that automated suggestions (AI-generated openers, ranking, content recommendations) will be accurate, relevant, safe or appropriate for you.
Members are not employees, agents, contractors or representatives of Dear Jane. We are not your fiduciary. We are not insuring your safety. We are a technology platform that lets you find people; what you do with that information is yours.
Some jurisdictions do not allow the disclaimer of certain implied warranties. To the extent we cannot disclaim a warranty under applicable law, the disclaimer above does not apply to that warranty for residents of that jurisdiction.
Limitation of liability
To the maximum extent permitted by law, Dear Jane and its officers, directors, employees, contractors, agents, affiliates, successors and licensors (together, the Dear Jane Parties) will not be liable to you for any indirect, incidental, special, consequential, exemplary or punitive damages, including but not limited to: lost profits, lost revenue, lost savings, lost opportunities, lost data, lost goodwill, work stoppage, computer failure, the cost of substitute services, or any damages arising from the conduct of another Member — whether based in contract, tort (including negligence), strict liability, statute, or any other legal theory, and whether or not we have been advised of the possibility of such damages.
The aggregate liability of the Dear Jane Parties for any and all claims relating to the Service is limited to the greater of (a) the total amount you paid Dear Jane in the twelve (12) months immediately before the event giving rise to the claim, or (b) one hundred US dollars (USD 100).
The limitations in this Section apply even if a remedy fails of its essential purpose. Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under applicable law — including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.
Indemnification
You agree to defend, indemnify and hold harmless the Dear Jane Parties from and against any claim, damage, loss, liability, fine, regulatory action or expense (including reasonable legal fees) that arises from or relates to:
- your use of the Service;
- Your Content;
- your interaction with any other Member, online or offline;
- your breach of these Terms, any Service rule, or any applicable law;
- your violation of any third party's rights — including rights of privacy, publicity, intellectual property and consumer protection.
We may, at our option and at your cost, assume the exclusive defence and control of any matter for which you owe indemnification. You agree to cooperate fully with our defence and not to settle any matter that includes an admission of fault on our behalf without our prior written consent.
Dispute resolution & arbitration
Informal resolution first
Before filing any formal claim, you agree to contact us at legal@dearjane.me with a written description of the dispute, the relief you seek and any supporting documents. We will respond within 30 days. We will attempt to resolve the dispute in good faith for at least another 30 days before either side commences formal proceedings. This informal-resolution step is a condition precedent to formal dispute resolution.
Binding arbitration
If we cannot resolve the dispute informally, you and Dear Jane agree that it will be resolved by final, binding arbitration in Larnaca, Cyprus, conducted in English under the ICC Rules of Arbitration of the International Chamber of Commerce in force at the time the arbitration is commenced, by a single arbitrator agreed between the parties, or appointed under those rules if we cannot agree.
The arbitrator may grant any relief that a court of competent jurisdiction could grant, but only on an individual basis. The decision of the arbitrator is final and may be enforced in any court of competent jurisdiction.
Carve-outs from arbitration
Either party may bring the following matters in court instead:
- actions to enforce or protect intellectual-property rights or trade secrets;
- small-claims actions, if individually permitted by the small-claims court of the consumer's home jurisdiction;
- actions to obtain interim or injunctive relief.
Mandatory consumer law
If you are a consumer resident in a jurisdiction whose mandatory law gives you a non-waivable right to bring proceedings in your local courts (for example, the EU Brussels Regulation), the arbitration provisions above do not apply to you to the extent of that non-waivable right.
Class-action waiver
To the extent permitted by applicable law, you and Dear Jane agree that each may bring claims against the other only on an individual basis, and not as a plaintiff or class member in any purported class, consolidated, mass, representative or private- attorney-general action. The arbitrator has no authority to award relief on behalf of anyone other than the named parties to the arbitration.
If this class-action waiver is found unenforceable, the entirety of the arbitration agreement in Section 28 will be null and void as to the disputes affected, and the dispute will proceed in the courts of competent jurisdiction designated in Section 32.
Notices & electronic communications
You consent to receive electronic communications from us — including transactional emails, billing receipts, safety advisories, security alerts and material updates to these Terms or our Privacy Policy. These communications satisfy any legal requirement that they be in writing.
We may give you notice at the email address associated with your
account, by an in-product banner, or by posting at
dearjane.me/legal. Notice is deemed given on the date
we send the email or post the banner, whichever is earlier. You
must keep your email address current.
Marketing emails are optional and contain an unsubscribe link in every message. Cancelling marketing does not unsubscribe you from transactional or safety emails — those are part of running the account.

Changes to these Terms
We may update these Terms from time to time to reflect changes in the Service, in our practices, or in the law. When the changes are material, we will tell you — by email and / or in-product notice — at least 14 days before they take effect and bump the "Last updated" date at the top of this page.
Continued use of the Service after the effective date of any update constitutes your acceptance of the updated Terms. If you do not agree, close your account before the effective date.
Non-material updates (typos, wording clarifications, link fixes) may be made without prior notice; we will still update the "Last updated" date.
Miscellaneous
Governing law
These Terms and any dispute arising out of them or out of the Service are governed by the laws of the Republic of Cyprus, without regard to its conflict-of-laws principles. Subject to Section 28, the competent courts of Larnaca, Cyprus have exclusive jurisdiction over any matter that does not go to arbitration.
Mandatory consumer rights
If you are a consumer, you may also rely on any mandatory provision of the law of the country where you are habitually resident that cannot be derogated from by agreement.
Force majeure
Neither party is liable for any delay or failure to perform its obligations under these Terms caused by a Force Majeure Event, for as long as the event continues. We will use commercially reasonable efforts to limit the disruption.
Assignment
You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. We may assign or transfer ours, in whole or in part, without notice (for example, as part of a merger, acquisition or financing).
No third-party beneficiaries
Except for the Dear Jane Parties (who may enforce the disclaimers and the limitation-of-liability section in their own right), there are no third-party beneficiaries to these Terms.
No agency
Nothing in these Terms creates any agency, partnership, joint venture, employment or franchise relationship between you and Dear Jane.
Severability
If a court of competent jurisdiction finds any provision of these Terms invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it valid and enforceable, or, if it cannot be modified, severed; the remaining provisions continue in full force.
No waiver
Our failure to enforce any right or provision is not a waiver of that right or provision in the future.
Entire agreement
These Terms (together with the Privacy Policy, Community Guidelines when published, and any feature-specific terms surfaced inside the Service) constitute the entire agreement between you and Dear Jane regarding the Service and supersede all prior agreements on the same subject.
Translations
We may translate these Terms into other languages. If a translation conflicts with the English original, the English text controls.
